Signing quotes and accepting services from The Cold Standard is an implied acceptance to the terms and conditions here within. Whenever possible we will send a copy of the agreement for signature, however when helping neighbors sometimes we have no way to provide this contract for signature before accepting services.

This Contract

is entered into between The Cold Standard (hereafter referred to as \"Contractor\") and the client for the provision of snow plowing services at the clients service address for the winter season of 2026–2027, which will commence on October 15th, 2026, and conclude on April 15th, 2027.

The Contractor agrees to deliver snow plowing or snow blowing services in a professional and timely manner. The scope of services includes the plowing or blowing of driveways and the shoveling or blowing of designated front walkway areas when snowfall exceeds 2 inches, unless otherwise specified in writing.

In instances of heavy (6+ inches) snowfall accumulation, multiple service visits may be required. Driveways will generally be serviced within 12 hours following the conclusion of a storm, with a maximum of 24 hours allowed during extreme weather conditions. During heavy snowfalls the contractor will attempt to plow through the storm to keep properties accessible. The Contractor primarily services residential sites during working hours when most vehicles are not obstructing driveways. Should the Client prefer night service, please inform us, and we will endeavor to accommodate this request.

Professional Standards

The Contractor is dedicated to upholding professional standards by maintaining a clean and presentable image while providing reliable service on site. Subcontractors may be utilized as necessary to fulfill the work requirements. We are an equal opportunity employer, hiring only individuals legally authorized to work in the United States, and we maintain all necessary insurance, including liability, workers' compensation, and commercial auto coverage.

Client Responsibilities

The Client agrees to:

Keep driveways reasonably accessible during snow events (removing parked vehicles, trash bins, etc.).
Accept service delays if vehicles, obstructions, or unmarked hazards impede access.

The Contractor is not liable for damages to items, including but not limited to utilities, mailboxes, outdoor lighting, curbing, landscaping, driveways, and walkways, that are not marked or that are damaged through standard operational procedures.

Payment Terms

Monthly invoices are due by the 15th of each month from October through March.
Per push invoices will be issued following each storm cycle to the customer’s email, with payment due upon receipt.
A late fee of $50 or 5% will be applied to overdue invoices.
Service may be suspended on overdue accounts without liability.
Refunds or credits for unused services are at the sole discretion of the Contractor.

For flat-rate clients who cancel early, the Contractor reserves the right to reconcile the account using per-service pricing and to collect 75% of the remaining contract balance immediately to cover operational losses associated with reserved route space.

Legal Protections

Hold Harmless Clause

The Client agrees to hold harmless the Contractor, its owners, employees, and subcontractors from any claims, damages, losses, or legal expenses that arise from snow and ice conditions, third-party accidents, or slip and fall incidents occurring on the Client’s property, even if services have been rendered.

Indemnification

The Client shall indemnify and defend the Contractor against any liability or litigation resulting from property damage, bodily injury, or contractual disputes, except in cases of gross negligence.

Acts of God

The Contractor shall not be held liable for service delays or incidents resulting from weather emergencies, heavy snowfall, blizzards, or any natural events beyond the Contractor’s control.

Property Damage Disclaimer

The Contractor is not responsible for damage resulting from gravel service, turf damage, driveway damage, or any property damage caused by hidden or improperly marked hazards.

Cancellation Policy

Either party may terminate this agreement with 30 days written notice (via certified mail or email). Upon cancellation, all services rendered up to that date will be billed, and 75% of the remaining balance will become due immediately if the Client is on a monthly plan.

Photo & Marketing Rights

The Client grants permission for property photos and videos to be captured for site documentation and marketing purposes. The Client also agrees to receive email marketing communications from The Cold Standard.

The Client grants permission for snow stake ads to be placed at the end of the driveway.

Authority to Sign

The signer of this Agreement confirms that they are fully authorized to bind the Client or property owner to the terms outlined herein.

Entire Agreement

This Agreement constitutes the complete understanding between the Client and Contractor. No oral modifications shall be binding. Any changes must be documented in writing and signed by both parties.
